Terms of Service

Last updated: 2 October 2026

These terms govern your use of the OrderKit platform and website, operated by [Registered company name] ("OrderKit", "we", "us"). By signing up for or using OrderKit, you agree to these terms.

The service

OrderKit gives restaurants direct ordering on WhatsApp, a branded web store and web app, an AI ordering and support assistant, table bookings, payments, delivery tools, marketing and reporting. Features depend on your plan.

Your account

You are responsible for the information you give us, for keeping your login details secure, and for everything done under your account. You must have the authority to act for the restaurant you register, and your menu, prices, hours and policies must be accurate and lawful.

Fees and billing

Diner data and your responsibilities

For your diners' personal information, you are the responsible party under POPIA and OrderKit is your operator. You must have a lawful basis to collect and use diner information, obtain marketing consent where required, and handle requests from your diners. We process diner information on your instructions, as set out in our Privacy Policy.

Payments and third parties

Payments are processed by third-party providers (such as Yoco, PayFast, Paystack and Ozow) under their own terms. Deliveries may involve your own drivers or a delivery partner dispatched through OrderKit. We are not responsible for the acts of these third parties beyond our role in connecting the service.

Acceptable use

Do not use OrderKit to break the law, send messages to people who have not consented, infringe anyone's rights, or disrupt the service. We may suspend an account that does.

Availability

We work to keep OrderKit running reliably but do not guarantee it will be uninterrupted or error-free. The service is provided on an "as is" basis to the extent allowed by law.

Limitation of liability

To the extent permitted by law, OrderKit is not liable for indirect or consequential loss, and our total liability for any claim is limited to the fees you paid us in the three months before the claim arose. Nothing here limits liability that cannot be limited by law.

Termination

You may stop using OrderKit at any time. We may suspend or end an account for a material breach of these terms. On termination you can ask us to remove your data, subject to any records we must keep by law.

Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.

Changes

We may update these terms from time to time. The date at the top shows when they last changed; continued use means you accept the updated terms.
